Cosmetics Registration
Imported cosmetics have a significant influence on the Indian market, with Indian consumers increasingly seeking international brands as a means of enhancing their lifestyle. Foreign products have contributed to the growth of the Indian market by attracting aspirational consumers. Additionally, the rapid expansion of organized retail in India has further fueled the demand for imported cosmetic products.
The following licenses are required for the manufacturing and marketing of cosmetic products in India, as per the Drug and Cosmetics Act, 1940:
- License on Form 32 : Issued for the manufacture, sale, or distribution of cosmetics (Form 31).
- License on Form 32-A : Issued for a loan license to manufacture, sell, or distribute cosmetics (Form 31-A).
- License on Form 37 : Issued for the grant or renewal of approval for conducting tests on drugs, cosmetics, or raw materials used in their manufacture, on behalf of the licensee for manufacturing or selling drugs and cosmetics (Form 36).
The following documents are required for the grant of a cosmetic license for the sale of drugs and cosmetics in India:
- Application forms
- Challan of fee payment
- Declaration form
- Key plan (Blueprint)
- Site plan (Blueprint)
- Proof of possession of the premises
- Proof of ownership of the premises, or rental agreement
- Proof of the firm’s constitution (certified copy)
- Affidavit of non-conviction for the proprietor, partners, or directors under the Drugs & Cosmetics Act, 1940
- Certified copy of the Registration Certificate from the Delhi Pharmacy Council, or Experience Certificate of a Registered Pharmacist/Competent person, along with qualification certificates
- Bio-data form
- Affidavit from the Registered Pharmacist/Competent person confirming full-time employment with the firm, duly attested by a Notary
- Appointment letter for the Registered Pharmacist/Competent person in charge, if applicable
The licensing authority appointed by the State Government issues the license for the manufacturing of cosmetic products. The manufacturer must ensure that production is carried out under the supervision of competent and qualified technical staff, with at least one person meeting the following educational qualifications:
- A Diploma in Pharmacy approved by the Pharmacy Council of India under the Pharmacy Act, 1948
- Registration under the Pharmacy Act, 1948
- Successful completion of an intermediate examination with Chemistry as one of the subjects, or any other qualification recognized by the Licensing Authority as equivalent.

Additionally, the Licensing Authority mandates an inspection of the premises by authorized inspectors before granting or rejecting the cosmetic license. A detailed report is submitted to the Licensing Authority, which will then decide whether to grant the cosmetic license.
